Reuters is reporting that a $100 million claim has been filed on behalf of a 6-year-old survivor of the Sandy Hook Elementary School shooting which took the lives of twenty children and six adults on December 14th.
The survivor, known as “Jill Doe,” is represented by attorney Irv Pinsky from New Haven, Connecticut. He claims that “Jill Doe” heard “cursing, screaming, and shooting” over the school intercom and “As a consequence, the child has sustained emotional and psychological trauma and injury, the nature and extent of which are yet to be determined.”
This claim was filed on Thursday with state Claims Commissioner J. Paul Vance Jr. The claim states that the state Board of Education, Department of Education and Education Commissioner had failed to take appropriate steps to protect children from “foreseeable harm.” Pinsky also accused the named organizations of failing to provide a “safe school setting” and “an effective student safety emergency response plan and protocol.”
The attorney states he was approached by the parents of “Jill Doe” within a week of the shooting.
I think it was inevitable that lawsuits would be filed as a result of this tragedy. I don’t think many would be shocked to read this. I am surprised that it came so soon and of the large sum for a survivor with no physical injuries. There is no doubt in my mind that this child sustained psychological trauma and will most likely suffer from this for the rest of her life. I am not sure how one can even place a dollar amount on that type of thing.
I do question the statement about failing to protect children from “foreseeable harm.” Who could possibly foresee this tragedy? Didn’t the Principal recently implement new security measures? All visitors had to be buzzed into the front office and show a photo ID once the doors were locked in the morning. I am not sure how you stop a psychotic man that is heavily armed and on a mission that is fueled by demons the likes of which most of us could never fathom.
